Ohio's Division of Cannabis Control recently proposed fines totaling $212,000 against five marijuana businesses for violating the state's strict advertising regulations. These penalties highlight the ongoing challenge marijuana companies face in navigating the complex legal landscape surrounding their marketing efforts.

One of the most significant fines, $150,000, was levied against Greenleaf Apothecaries, which operates dispensaries across several Ohio cities, including Akron, Cleveland, and Columbus. The company faced penalties for distributing food and drinks from an ice cream truck, promoting "Free Ice Cream" on social media, and using an unauthorized sign not affixed to their dispensary. While Greenleaf Apothecaries expressed their commitment to complying with regulations and hoped to resolve the issue, the incident underscores the difficulties marijuana businesses encounter when trying to attract customers within the bounds of the law.

To legally advertise in Ohio, marijuana companies must adhere to strict guidelines. These include using state-approved signs, avoiding promotions that appeal to minors, and ensuring that all advertising content is truthful and not misleading. For instance, instead of gimmicks like free food or provocative slogans, businesses might focus on educational campaigns that emphasize the benefits of their products, customer testimonials, or partnerships with local community organizations.

The stringent advertising laws in the marijuana industry are primarily designed to protect public health and safety. Regulators are particularly concerned about preventing advertisements that might appeal to children or glamorize drug use. This is why promotions involving ice cream trucks, which could easily attract minors, are strictly off-limits. Similarly, slogans like “Can you take me higher?” might be viewed as promoting excessive or irresponsible use, something regulators are keen to avoid.
